You have 3 weeks to fight a dismissal in Germany, even from India

Your boss can fire you while you're on approved leave, and the 3-week clock starts when the letter hits your mailbox, not when you read it. Here's how to protect yourself before your next India trip.

Your boss sends you a Teams invite while you're on approved leave. The topic is your termination. A formal letter will follow by post.

One employee in Germany recently asked online if this is even legal. If you lose your job while you're abroad, the next three weeks decide almost everything. Here's what the rules say and what you can do.

Can your employer fire you while you're on vacation?

Yes. German law gives no special protection to people on approved annual leave (Urlaub). An employer can send a termination while you're on a beach in Goa or at your parents' home in Pune.

Being on leave doesn't stop the process. It only makes it harder for you to react.

Does a Teams call or WhatsApp message end your job?

No. A termination by Teams, WhatsApp or email is legally invalid. Section 623 of the German Civil Code (BGB § 623) says a termination needs a paper letter with an original signature in ink.

So the call itself doesn't end your contract. But it gives you a warning: the real letter is coming.

Why does the mailbox matter more than your flight?

Section 4 of the Protection Against Dismissal Act (KSchG § 4) gives you three weeks. In that time you must file an unfair dismissal claim (Kündigungsschutzklage) at the labor court, which handles job disputes. Three weeks is 21 days.

If you miss this deadline, the termination becomes valid. It stays valid even if your employer had no good reason to fire you.

Here is the trap. The clock starts when the letter enters your home mailbox in Germany (BGB § 130). It does not start when you come back and read it. It makes no difference if your employer knows you're out of the country.

The Federal Labor Court (Bundesarbeitsgericht, or BAG) confirmed this in a judgment of 22 March 2012 (2 AZR 224/11). A letter that lands in your mailbox during your holiday counts as received.

What if you miss the 3 weeks because you were in India?

There is a second chance, but don't rely on it. Section 5 of the same law (KSchG § 5) allows a late admission of your claim (Nachträgliche Klagezulassung). You must apply within two weeks after the obstacle ends, which means after you return home.

The problem is that the BAG expects people on longer trips to arrange for their mail. A court may decide you should have done more. Late admission is not guaranteed.

Many of us take three or four weeks to visit family. That is exactly the length of trip that puts you at risk.

Why does the deadline matter for severance?

Germany made this deadline strict to give employers fast legal certainty. For you, it also decides how much pressure you can put on your employer.

A lawsuit can push an employer to offer severance (Abfindung, a payment when you leave). Once the three weeks pass, that pressure is gone, and you have almost no room to negotiate. Planning to leave Germany after a job loss? Read our post on severance pay and moving your savings back to India.

Should you attend the optional meeting while on leave?

I would attend. A verbal notice isn't legally binding, so joining the call doesn't end your job.

The big benefit is the warning. Once you know a letter is coming, you can tell the person checking your mailbox to look for it every day. You can also line up a lawyer before the clock starts.

If you skip the call, you may learn about the letter weeks later.

What should you do before you travel and while you're away?

Plan before every trip longer than a week or two.

  1. Give a mailbox key to a trusted friend or neighbour in Germany.
  2. Ask them to check for official-looking letters and send you a photo straight away.
  3. Note the date the letter arrived. That date starts your three weeks.
  4. Contact a lawyer immediately if a termination letter arrives.

The lawyer you need is a Fachanwalt für Arbeitsrecht (a specialist lawyer for employment law). They can file the Kündigungsschutzklage electronically for you while you're still in India. That secures the deadline.

What should you do next?

Before your next flight to India, ask one person in Germany to check your mailbox. Then save the contact of a labor lawyer in your phone. A small bit of planning now can protect your whole claim.
